ABSTRACT

The rapid development of technology has led to groundbreaking innovations and the emergence of new digital phenomena. One of the most widely discussed technologies today is the Metaverse, a digital platform that presents a virtual representation of real-life activities and interactions. Legal protection for virtual property owners within the Metaverse remains a subject of debate, particularly from the perspective of Islamic law, as transactions involving virtual properties are often conducted using cryptocurrency. This study aims to examine the forms of legal protection available to virtual property owners on Metaverse platforms through a comparative analysis of Islamic law and civil law, as well as to analyze the role of such legal protection as an instrument of corruption prevention — particularly in deterring the misuse of cryptocurrency-based digital assets as a means of concealing and laundering proceeds of corruption. The research employs a normative juridical method using statutory and conceptual approaches. The study is expected to contribute a normative response to the existing legal vacuum (rechtsvacuum) in Indonesian positive law regarding virtual property ownership, while providing academic insights for bridging the legal gap between digital realities and existing legal frameworks, both under Islamic law and civil law.
